By creating an account or using the Top Trainer app or website, you agree to these Terms of Service with Wizebase LLC, doing business as Top Trainer Fitness ("Top Trainer", "we", "us"). Read them carefully. If you don't agree, don't use the service.

1. The service

Top Trainer is an iOS app that offers AI-generated workout programs, AI form analysis, AI coaching chat, workout logging, and progress tracking. It also includes a coaching platform: any subscriber can act as a coach (a "Top Trainer"), create a team with custom branding, and invite clients, who can join free of charge and — with the client's permission — share training data, receive assigned programs, and exchange realtime messages with their coach. We may add, change, or remove features at any time.

2. Eligibility

Top Trainer is rated 17+ on the App Store. You must be at least 17 years old to use Top Trainer. If you are under the age of majority where you live, a parent or legal guardian must review and accept these Terms on your behalf. By using the app you confirm you meet this age requirement and can enter into this agreement.

3. Your account

You are responsible for keeping your account credentials secure.
One person per account; no sharing.
We may suspend or terminate accounts that violate these terms, misuse the AI features, or attempt to bypass usage caps.

4. Subscriptions and billing

Top Trainer Pro is sold as an auto-renewing subscription through Apple's App Store. Pricing is shown in the app at purchase. The subscription includes monthly allowances for AI Coaching Sessions, Program Weeks, Video Form Analyses, Image Analyses, and Routine Creations.

Billing: Top Trainer Pro is a paid subscription charged at the time of purchase through your iPhone's Subscriptions screen. There is no free trial.
Renewal: the subscription auto-renews monthly unless cancelled at least 24 hours before the renewal date.
Cancel: at any time via iOS Settings → your name → Subscriptions. Cancellation takes effect at the end of the current period.
Refunds: all refunds are handled by Apple. We do not control Apple's refund decisions.
Add-on packs: consumable in-app purchases (extra AI coaching sessions, program weeks, etc.) are non-refundable once granted to your account.
Add-on carryover: unused purchased add-on quota carries forward into your next monthly cycle. Included monthly quota does not carry over.
No coach payments through the app: Top Trainer does not process, facilitate, collect, or guarantee any payment between a coach and a client. Joining a coach's team in the app is free.

5. The coaching platform

Any subscriber can become a coach, create a team with custom branding (banner image, logo, tagline, accent color), and invite clients via an invite code, link, or QR code. This section explains what we are — and are not — in that relationship.

5.1 We are a software platform, not a training provider

Top Trainer provides the software that connects coaches and clients. Coaches are independent users of the app. They are NOT our employees, agents, partners, representatives, or contractors, and they do not speak for us. We do not vet, interview, background-check, certify, license, endorse, recommend, or supervise any coach, and we make no representation or warranty about any coach's qualifications, credentials, experience, conduct, or the safety, quality, or suitability of their advice or programming. The decision to train with a coach — and to follow anything a coach tells you — is yours alone.

5.2 The coach–client relationship

Any coaching relationship formed through the app is solely between the coach and the client. We are not a party to it. If a coach charges for their services, that arrangement — its pricing, billing, taxes, refunds, and performance — happens entirely off-platform and is entirely between the two of you. Any dispute between a coach and a client is their own affair; we have no obligation to mediate or resolve it, although we may, at our sole discretion, take action against users who violate these Terms.

5.3 Teams, invites, and permissions

Joining a team grants a coach no access to your data by default. You choose which permissions to grant — workout history, calendar, training stats, and (optionally) Apple Health–derived vitals such as heart rate and sleep.
A coach with the relevant permissions may view the data you shared, assign programs and routines, add entries to your calendar, and message you in realtime chat.
You can revoke any permission, or leave a team entirely, at any time. Leaving ends the coach's access going forward.

5.4 Coach branding and conduct

Team branding is user content, not ours, and does not imply our endorsement. If you act as a coach, you must own or have the rights to every branding asset you upload. You may not use names, logos, or marks that infringe someone else's trademark, impersonate another brand or person, or claim certifications or credentials you do not hold. We may remove or alter branding, content, or entire teams that violate these Terms, and may suspend or terminate the accounts involved.

6. Health data you share with a coach

Sharing training or health data with a coach is entirely client-initiated: nothing is shared until you grant a permission, each grant is separate, and you can revoke any of them at any time. Once you share data with a coach, that coach — a human being independent of us — can see it, and we cannot control what a person does with information they have viewed. To the maximum extent permitted by law, we are not responsible or liable for a coach's use, disclosure, retention, or misuse of data you chose to share with them. Revoking a permission or leaving a team stops future access but cannot recall information a coach has already seen. Share sensitive data, especially health vitals, only with coaches you trust.

7. AI-generated content

The AI coach (Max) generates workout programs, exercise recommendations, and chat responses based on your inputs. AI output can be wrong, generic, outdated, or unsuitable for your specific situation. Max is not a licensed physician, physical therapist, dietitian, or certified trainer, and nothing it says is professional advice. You are solely responsible for evaluating any recommendation before acting on it.

If you are on a coach's team, Max acts as an assistant to your coach, and your coach may give Max standing rules or guidance that shape its answers to you. Those coach rules are the coach's content, not ours: applying them through Max does not mean we reviewed, approved, or endorsed them, and it does not make the coach's advice our advice.

8. Health and medical disclaimer; assumption of risk

Top Trainer is a fitness coaching app, NOT a medical service. The content generated by the app — and any content provided by a coach — is educational and motivational; it is not medical advice, diagnosis, or treatment. Consult a qualified physician before starting any new exercise program, especially if you have a heart condition, joint problem, pregnancy, recent injury, or any other medical concern. Stop training immediately and seek medical help if you experience chest pain, dizziness, sharp joint pain, or any other warning sign.

Physical exercise carries inherent risk, including muscle strains, joint and tendon injuries, cardiovascular events, and, in rare cases, death. By using Top Trainer — whether you follow AI-generated programming, a coach's programming, or your own — you knowingly and voluntarily assume all risks associated with exercise, to the maximum extent permitted by law.

9. Acceptable use

You agree NOT to:

Reverse-engineer, decompile, or extract the app's code or our AI prompts;
Attempt to bypass usage caps, subscription gates, or any other access control;
Use the AI features to generate medical advice for others, content that violates laws, or content that harms minors;
Upload photos, videos, or chat content that violates someone else's privacy or intellectual property;
Use team invites, chat, or media sharing to harass, threaten, stalk, defraud, or spam other users, or to send unlawful, hateful, or sexually exploitative content;
Misrepresent your identity, credentials, or certifications when acting as a coach;
Use the service to train a competing AI model or scrape Top Trainer's output at scale.

We may remove content, branding, messages, or teams that violate these rules, and may suspend or terminate the accounts responsible, without prior notice.

10. Your content

You retain ownership of the photos, videos, workouts, team branding, coach rules, and chat messages you create. By using the app you grant us a limited, worldwide, royalty-free license to store, host, transmit, process, and display that content for the sole purpose of providing the service — for example running form analysis, syncing across your devices, generating coaching responses, delivering your messages and media to the other participant in a chat, and showing data you chose to share to the coach or client you shared it with. The license ends when you delete the content or your account, except for copies already delivered to other users (e.g. messages a recipient has received) and backups retained for a short period in the ordinary course.

11. Intellectual property

The Top Trainer app, website, brand name, logo, AI prompt design, and all software are owned by Top Trainer Fitness. You receive a personal, non-transferable license to use the service while your subscription is active. No reverse-engineering, no redistribution.

12. Service availability

We aim for high uptime but cannot guarantee uninterrupted service. The app depends on Apple's App Store, Supabase, Anthropic, Google, and your internet connection. Outages at any of those layers may temporarily prevent specific features from working.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI OUTPUT IS ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC GOALS. WE DO NOT WARRANT, AND ARE NOT RESPONSIBLE FOR, THE ADVICE, PROGRAMMING, CONDUCT, OR QUALIFICATIONS OF ANY COACH; CONTENT PROVIDED BY A COACH IS THE SOLE RESPONSIBILITY OF THAT COACH.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOP TRAINER FITNESS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BODILY INJURY ARISING FROM YOUR USE OF THE APP, NOR FOR ANY DAMAGES ARISING FROM ANY INTERACTION, RELATIONSHIP, ADVICE, PROGRAMMING, DATA SHARING, OR OFF-PLATFORM ARRANGEMENT BETWEEN A COACH AND A CLIENT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM (OR $50, WHICHEVER IS GREATER).

15. Indemnification

You agree to indemnify, defend, and hold harmless Top Trainer Fitness, Wizebase LLC, and their owners, officers, and personnel from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) content you create, upload, or share, including team branding and coach rules; (c) your conduct as a coach, including any advice or programming you give a client; (d) your interactions, relationships, or off-platform arrangements with other users, including coach–client disputes; or (e) your use or disclosure of data another user chose to share with you.

16. Termination

You can terminate this agreement at any time by deleting your account. We may terminate or suspend your access — and may remove content, branding, or entire teams — if you violate these terms. On termination, your data is deleted per the Privacy Policy.

17. Changes to these Terms

We may revise these Terms. Material changes will be surfaced in the app and on this page with a revised "Last updated" date. Continued use after a change constitutes acceptance.

18. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the state or federal courts located in Delaware, unless your local consumer-protection law requires otherwise.
